Protections for Nursing Mothers Have Expanded

As of December 29, 2025, updates to the federal Providing Urgent Maternal Protections (PUMP) Act have expanded workplace protections for nursing employees. Certain employees of rail carriers and motorcoach service operators are now covered under the Fair Labor Standards Act (FLSA) requirements.

Eligible employees have the right to reasonable break time to express breast milk and access to a private space to pump while at work. This space must be shielded from view, free from intrusion and cannot be a bathroom. These protections may apply for up to one year following the birth of a child. New exemptions may apply in cases where compliance would cause significant expense or create unsafe conditions.
